Bank account seizure: how it works and how long it can take

Bank account seizure is one of the most significant measures in an enforcement action for debt collection. For the creditor, it can represent an effective way to try to recover outstanding amounts. For the debtor, it can arise as an unexpected freeze on funds, with a direct impact on day-to-day management. In Portugal, bank account seizure does not happen simply at the creditor's will. It depends on a legal process, usually an enforcement action, an enforceable title, and the intervention of an enforcement agent. The objective is to seize funds existing in the debtor's accounts or deposits, within legal limits, to satisfy a debt recognized by a sufficient title. Despite being a frequent mechanism, it raises many questions: how long does it take, what amounts can be frozen, can the bank refuse, is there a protected minimum, and what can someone do who is surprised by having their account seized?.
